Agreement to Terms
By accessing or using SwiftFund's application at apply.leadpop.io ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
What SwiftFund Is — and Isn't
SwiftFund is a lead generation service. We are not a lender, not a bank, and not a financial institution. We do not make loans, merchant cash advances, or any form of financing. We do not make funding decisions. We do not contact you about funding after you submit your information — our lending partners do.
Our Service provides a pre-qualification quiz that helps determine whether you may be a match for business funding products offered by third-party lending partners in our network. Upon submission, we share your information with those partners, who independently evaluate your inquiry and contact you directly.
Consent to Data Sharing and Partner Contact
By completing our contact form and clicking "Verify My Phone," you expressly:
- Authorize SwiftFund to share your personal information (including your name, phone number, email address, business name, and quiz answers) with our network of lending partners and funding providers
- Consent to be contacted by those lending partners — not by SwiftFund — by telephone (including autodialed or pre-recorded calls), SMS text messages, and email at the contact information you provide, for the purpose of discussing business funding options
- Acknowledge that SwiftFund is not responsible for the content, timing, frequency, or conduct of those contacts
This consent covers contact from lending partners in our network who may reach out regarding your inquiry even if your phone number is on a federal or state Do Not Call registry, because you are providing express written consent to be contacted.
Your consent is not required as a condition of receiving any funding product. If you do not wish to have your information shared or to be contacted by lending partners, do not submit the contact form.
No Guarantee of Funding
Completing our quiz and providing your contact information does not guarantee:
- Approval for any funding product
- Any specific funding amount, interest rate, factor rate, or terms
- That any lending partner will contact you or make an offer
- That pre-qualification indicates creditworthiness or eligibility
All funding decisions are made solely by independent third-party lenders and funding providers based on their own underwriting criteria. Pre-qualification through our quiz is an estimate based solely on the information you provide and does not constitute a binding offer, commitment to lend, or guarantee of any kind.
Accuracy of Information
You represent that all information you provide through the Service is truthful, accurate, and complete. You agree not to misrepresent your revenue, time in business, credit score, or any other information. Providing false or misleading information may result in disqualification from funding opportunities and may constitute fraud.
Phone Verification
Our Service requires verification of your phone number via a one-time SMS code. By providing your phone number, you consent to receive this verification SMS from SwiftFund (sent via Twilio). Standard message and data rates may apply. This verification is required to confirm your identity and the accuracy of the contact information you provide to our lending partners.
Relationship with Lending Partners
Lending partners accessible through our Service are independent third parties. SwiftFund does not endorse any specific lender, funding product, rate, or term. We are not a party to any agreement between you and a lending partner. All terms, rates, fees, repayment schedules, and conditions are determined solely by the lending partner. You should carefully review all terms offered by any lending partner before entering into any agreement.
SwiftFund receives compensation from lending partners when a connection is made through our Service. This compensation does not affect which partners receive your information.
Third-Party Services
Our Service integrates with third-party providers including Twilio (SMS), GoHighLevel (CRM), Meta (advertising), and Google (analytics). Use of these services is also subject to their respective terms and privacy policies.
Intellectual Property
All content on the Service — including text, design, graphics, and the SwiftFund name and logo — is owned by SwiftFund or its licensors. You may not copy, modify, or distribute any content without our written permission.
Limitation of Liability
To the maximum extent permitted by applicable law, SwiftFund shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of, or inability to use, the Service
- Any funding decisions made by third-party lenders
- The terms, rates, fees, or conduct of any lending partner
- Any contact you receive from lending partners
- Any reliance on information provided through the Service
In no event shall SwiftFund's total liability to you exceed the amount you paid to use the Service (which is $0, as the Service is free to applicants).
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or secure. Information on the Service, including funding ranges, qualification estimates, and timing claims, is for general informational purposes only and does not constitute financial, legal, or tax advice.
Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.
Changes to These Terms
We may modify these Terms at any time by posting an updated version on this page. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
